# Terms of Service
Effective date: 8 April 2026
These terms govern your use of machine0.io and the machine0 CLI, operated by Fundamental Software SAS (RCS 102 706 348 R.C.S. Annecy, 74310 Les Houches, France). By using machine0, you agree to these terms.
## 1. Service Description
machine0 provides on-demand cloud virtual machines accessible via a command-line interface and web dashboard. VMs run on DigitalOcean infrastructure. You have full root-level SSH access to your VMs.
## 2. Account
- You must provide accurate information when creating your account.
- You are responsible for your credentials and all activity under your account.
- One account per person unless otherwise agreed in writing.
- You must be 18 years or older to use the service.
## 3. Acceptable Use
You must not:
- Use the service for unlawful purposes
- Mine cryptocurrency without prior written consent
- Attempt to access other customers' VMs or data
- Interfere with or disrupt service infrastructure
- Resell the service without prior written consent
- Transmit malware or conduct network attacks from VMs
- Use VMs to send unsolicited email (spam)
We may suspend or terminate accounts that violate these terms without refund.
## 4. Billing and Payment
- Billing is pay-as-you-go, charged per minute of VM usage.
- You fund a wallet via Stripe. Minimum top-up is $5 USD.
- Creating resources requires sufficient balance for 10 hours of usage.
- If your balance falls below 1 hour of runway, running resources may be automatically suspended or destroyed.
- All prices are in USD. VAT applies where required by law.
- Transaction records are retained for 10 years per French commercial accounting requirements (Code de Commerce Art. L123-22).
## 5. Your Data and VMs
- You retain all ownership of data stored on your VMs.
- We do not access, monitor, or inspect data inside your VMs unless required by law or to investigate a violation of these terms with reasonable suspicion.
- When you enable the HTTP proxy feature, web traffic to your VM transits our infrastructure. This traffic is forwarded in real-time and is not stored, logged, or inspected.
- You are responsible for backing up your data. VM destruction is irreversible.
- We act as a data processor for data stored on your VMs. See our Data Processing Agreement for details.
## 6. SSH Keys
- Your full SSH public key is stored on our servers. Public keys are not secret.
- For managed keys, the private key is stored encrypted at rest and is retrievable via the API.
- You are responsible for safeguarding your private keys.
## 7. Images and Snapshots
- Custom images are billed based on disk size.
- System images (base-24-04, openclaw, ubuntu-24-04) are provided as-is with no warranty.
- Custom images you create remain yours.
## 8. Availability and SLA
**VM Compute Uptime**
Your VMs run on DigitalOcean infrastructure, which carries the following SLAs:
- CPU VMs: 99.99% monthly uptime. See DigitalOcean CPU Droplet SLA.
- GPU VMs: 99% monthly uptime. See DigitalOcean GPU Droplet SLA.
If DigitalOcean's uptime commitment is breached for your VM, we will pass through service credits to your machine0 account. Credits are applied toward future machine0 usage and are not refundable as cash.
**SLA Exclusions**
The VM compute SLA does not cover:
- Scheduled maintenance or customer-initiated downtime
- Force majeure events, third-party outages, or customer equipment or network issues
- Downtime caused by customer application code or configuration
- Account violations or misuse of the service
**What Is Not Covered by This SLA**
The VM compute SLA covers the availability of your virtual machine instance. It does not cover the machine0 control plane (API, web dashboard, CLI authentication, HTTP proxy, or DNS). We target high availability for these services but do not guarantee specific uptime percentages for them.
**Maintenance**
Scheduled maintenance will be communicated in advance when possible.
**SLA Claims**
To file an SLA claim, contact [email protected] within 30 days of the affected billing period with your account details, affected VM identifiers, and the dates and times of the outage.
## 9. Limitation of Liability
- To the maximum extent permitted by law, Fundamental Software SAS's total liability is limited to the amount you paid in the 12 months preceding the claim.
- We are not liable for indirect, incidental, or consequential damages, including data loss.
- These limitations do not apply where prohibited by French or EU consumer protection law.
## 10. Indemnification
You agree to indemnify Fundamental Software SAS against claims arising from your use of the service, your violation of these terms, or your violation of any law or third-party rights.
## 11. Termination
- You may close your account at any time.
- We may terminate your account for violation of these terms.
- Upon termination, all VMs and images are destroyed. Account data is deleted within 30 days, subject to legal retention obligations (billing records retained for 10 years).
## 12. Intellectual Property
- The machine0 name, logo, and service are owned by Fundamental Software SAS.
- The machine0 CLI is closed source and owned by Fundamental Software SAS.
## 13. Governing Law
These terms are governed by French law. Disputes shall be submitted to the courts of Annecy, France, unless EU consumer protection regulations mandate otherwise.
## 14. Changes
We may update these terms. Material changes are communicated via email. Continued use of the service 30 days after notification constitutes acceptance.
